1. About these terms
These terms are an agreement between you and Lucero Studio, Morlans, San Sebastián, Spain, who runs Petalface ("we", "us"). They apply to the Petalface apps for iPhone, iPad and Android, to the web app at https://app.petalface.com and to the website at https://petalface.com, together "Petalface".
By creating an account, buying Pro or using Petalface, you accept these terms. If you do not accept them, do not use Petalface.
2. What Petalface does
Petalface shows a look on your own photo: a makeup look, a hair colour, a cut, a style or a length, nail designs, or a look for an occasion, tried on a photo of your face or your hand before you try it for real. You upload a photo, choose options or copy a look from a picture, and an AI model makes a new image of you in that look. Each design gets a short note written by AI. The Ideas section shows example looks made by us. With Pro, you can also talk to an AI assistant that makes and refines designs from your messages and photos and answers questions about makeup, hair and nails.
Before it makes a design, Petalface has an AI model look at your photo to read your skin depth and undertone, your hair texture and whether your hair is covered, so that the design keeps them. The privacy policy explains it.
The designs, notes and replies are made by AI models that other companies run for us. We cannot promise that a result will look the way you expect or meet your needs.
3. Privacy
Our privacy policy explains what we collect, why, and who helps us run Petalface. It is part of these terms.
4. Age and your account
- You must be at least 17 years old to use Petalface or buy Pro.
- Give a real email address and keep your sign-in details safe. You are responsible for what happens in your account.
- An account can be signed in on one device at a time. Signing in on a new device signs out the others. Do not share an account with other people.
5. Free and Pro
- Free: a number of designs each day. Images you save or share carry a Petalface watermark.
- Pro: more designs each day, no watermark on the images you save or share, the assistant, and the chance to keep designing from any result.
Each plan has daily limits, and the app tells you when you reach one. Daily limits start over each day in your time zone. A design that fails does not count toward your limit.
6. Buying Pro
Plans and prices
- Pro is sold as a weekly or a yearly subscription, or as a lifetime purchase. Not every plan is offered on every platform or in every country.
- The price, the billing period, any free trial and any tax are shown before you confirm a purchase. Prices can differ between the App Store, Google Play and the web, and between countries.
- A lifetime purchase is paid once. It keeps Pro on the account that bought it for as long as we offer Petalface.
In the iPhone, iPad and Android apps
Apple (App Store) or Google (Google Play) sells and bills Pro in the apps, under their own terms. For these purchases:
- Payment is charged to your Apple ID or Google account when you confirm the purchase.
- A subscription renews automatically for the same period and price unless you turn off auto-renewal at least 24 hours before the current period ends.
- The renewal is charged within the 24 hours before the current period ends.
- You manage and cancel subscriptions in your App Store or Google Play account settings after purchase. In Petalface, open Profile, then Plan, and choose Manage subscription to go there.
- If a free trial is offered, any unused part of it ends when you buy a subscription.
- When you cancel, Pro stays on until the end of the period you paid for. You are not charged again.
- Refunds for these purchases follow Apple's and Google's rules: ask them.
On the web
On the web, we sell Pro. Our payments provider, RevenueCat, runs the checkout and Stripe processes the payment. For these purchases:
- You pay when you confirm the purchase.
- A subscription renews automatically for the same period and price until you cancel it. Cancel before the end of a period to avoid the next charge. Open Profile, then Plan, and choose Manage subscription, or write to us.
- When you cancel, Pro stays on until the end of the period you paid for.
- For refunds, write to support@petalface.com.
Right of withdrawal (EU and UK, web purchases)
If you live in the European Union or the United Kingdom and buy Pro on the web, you can withdraw from the purchase within 14 days, without giving a reason. The 14 days start on the day of the purchase.
To withdraw, tell us before the 14 days end with a clear statement: an email to support@petalface.com is enough, or you can use the model form below. We refund you within 14 days of hearing from you, with the same means of payment, at no cost to you.
Pro is a service that runs for as long as your plan lasts. If you asked us at checkout to start Pro straight away, within the 14 days, and you then withdraw, you pay for the Pro you had until you told us: we refund the price less an amount in proportion to that time. If you did not ask for Pro to start straight away, we refund the full price.
The lifetime plan is the same Pro service, with no end date, so the same right of withdrawal applies to it. For the time you had it, we charge the yearly plan's daily rate: the price of the yearly Pro plan on the web when you bought, divided by 365, for each day until you told us. We refund the rest of the price.
If you live in the United Kingdom, you also have the rights that UK law on subscription contracts gives you, including any notices and cancellation periods it requires.
For App Store and Google Play purchases, refunds and withdrawals go through Apple's and Google's own processes: ask them.
Model withdrawal form (fill it in and send it only if you want to withdraw):
- To: Lucero Studio, Morlans, San Sebastián, Spain, support@petalface.com
- I hereby give notice that I withdraw from my contract for the following service: Petalface Pro, plan: ___
- Ordered on: ___
- Name: ___
- Address: ___
- Email address of the Petalface account: ___
- Signature (only if you send it on paper): ___
- Date: ___
Changes and cancellation
- If a price changes, we or the store tell you before the new price applies, and you can cancel before it does.
- Deleting the app or your account does not cancel a subscription. Cancel it in the store or account where you bought it.
7. Using Petalface fairly
In general
You agree not to:
- Use Petalface for anything illegal, or in a way that infringes other people's rights.
- Try to get around the daily limits, the watermark, the one-device rule or our security.
- Copy, decompile or reverse engineer Petalface, except where the law allows it.
- Resell, rent or redistribute Petalface, scrape it, or use it to build a competing service.
- Overload Petalface, or use bots or scripts to make designs.
With the AI tools
You agree not to use Petalface to:
- Harm, exploit or sexualise children in any way.
- Deceive people, for example by passing an edited photo off as an unedited one where that deceives: on an identity document, a dating profile, a job or a school application, or anywhere that asks for an unedited photo. Do not spread false information either.
- Harass, bully, threaten or humiliate anyone, or show real people in a false, hurtful or sexual way.
- Discriminate against people or groups.
- Make things that infringe copyrights, trademarks or other rights.
What you may not upload or create
- Illegal content.
- Sexual or nude content, or photos showing intimate parts of the body. The photo a design starts from must show a face or a hand, with nothing intimate in it.
- Hateful, violent or gory content.
- Photos of a child.
- Photos of another person's face or hands without their consent. The only exception is a picture of a look to copy, which follows its own rules below.
- Malware, or anything meant to harm Petalface or its users.
We may remove content or suspend an account that breaks these rules. We may report illegal content to the authorities.
A picture of a look to copy
In Copy a look, Copy a hairstyle and Copy a manicure, and in the assistant, you can add a second picture: a look you would like to try. It can be a screenshot, a photo from a magazine or a website, or one of the example looks in the Ideas section. It may show another person's makeup, hair or nails, and that person does not need to have agreed. Petalface uses only the makeup, the hairstyle or the nails in it, on your own photo. It never puts that person's face, features or skin on yours.
Add only a picture you are allowed to use. It must not:
- show a child;
- show anything intimate;
- be meant to mock, harass or humiliate the person in it, or to pass them off as someone they are not.
All the other rules in this section apply to it as they do to any picture. The photo a design starts from, your own, keeps the rules above: it must show your own face or hand, or an adult's who has agreed. We may remove a picture that breaks these rules.
8. Your content
"Your content" means the photos and pictures you upload, the words you type, your messages to the assistant, and the designs and notes made for you.
When you upload a photo for a design to start from, you promise that:
- You took it, or you have permission to use it.
- It shows your own face or hands, or those of an adult who has agreed. It never shows a child.
- Every person who can be recognised in it, or whose body it shows, is an adult and has agreed.
- It shows nothing intimate.
When you add a picture of a look to copy (section 7), you promise that you are allowed to use it, that it shows no child and nothing intimate, and that you do not use it to mock, harass or humiliate the person in it. The person in it does not need to have agreed.
Your content stays yours. You give us a licence to store, process and show it, and to send it to the providers named in our privacy policy, only to provide Petalface to you. This licence ends when you delete the content or your account.
9. AI results are previews, not promises or advice
Designs, notes and assistant replies are made by AI. They can be inaccurate, change things you did not ask for, or show a look that would not turn out that way in real life. They are previews, to help you decide and to show to a hairdresser, a makeup artist or a nail technician.
- A design is a preview, not a result. Real makeup, hair colour, cuts and nails depend on your hair, your skin, your nails and the salon, the products and the person who does them. A look that works on the picture may not work the same on you, and we do not promise that a salon or a product will give you the same result.
- Colours on a screen, and shades in a picture, differ from the real thing and from one screen to another.
- No brand is endorsed. Petalface does not name or recommend any brand, product or salon. The looks and shades in it are described in plain words.
- Health and care: what the assistant or a note says about skin, hair care, products, allergies, sensitivity, hair colouring, nails or any condition is general information, not medical, dermatological or hair-care advice. Ask a doctor, a dermatologist or a professional before you change your hair, nails or skin care. If you are going to use a colour, bleach, a dye, a nail product or a cosmetic, a patch test is yours to do, following the maker's instructions.
- Your photo and your face: Petalface shows a look on your own photo. It does not reshape your face or body, and it does not tell you what to change about them.
The decision to try a look, and where and by whom, is yours. We are not responsible for a visit, a treatment or a product you choose, or how it turns out.
10. Intellectual property
Ours
Petalface, its name and logo, its design, pictures, texts and software belong to us or our licensors. We give you a personal, limited, non-exclusive, non-transferable right to use Petalface under these terms. We can take this right back if you break them.
Yours
As between you and us, you own the designs made for you, as far as the law allows rights in them. You may use them as you like, including commercially, within the law and these terms. Designs from the free plan carry a watermark; do not remove it.
AI models can make similar designs for other people from similar words, photos and choices, and a design may look like an existing look or someone's work. You do not get exclusive rights to a style or a look, and other people's similar designs are not yours. Before you use a design commercially, make sure it does not copy someone else's work, logo or character.
The example designs in the Ideas section are ours, and they are made with AI. You may use them as references for your own look, including showing them to a hairdresser, a makeup artist or a nail technician, but not resell or redistribute them.
Copyright complaints
If you believe something in Petalface infringes your copyright, write to support@petalface.com or to Morlans, San Sebastián, Spain. Include: your contact details; the work you believe is infringed; where the content is in Petalface; a statement that you believe in good faith that the use is not authorised; a statement, under penalty of perjury, that your notice is accurate and that you own the right or may act for its owner; and your physical or electronic signature. We may remove the content and tell the person who uploaded it, who can send a counter-notice to the same address.
11. Other services and links
Petalface links to services we do not run, such as the App Store, Google Play and the sign-in pages of Apple and Google. Their own terms and privacy policies apply to them, and we are not responsible for them.
12. Availability, changes and ending the agreement
- We may change, add or remove features, or limit or stop Petalface. If we remove something you pay for, we tell you first.
- Petalface needs an internet connection. Your mobile operator's data charges are yours.
- You can stop using Petalface and delete your account at any time. See the account deletion page.
- We may suspend or close your account if you break these terms, if the law requires it, or if we stop offering Petalface. If we close your account without a breach on your part, we tell you first when we can, and refund any prepaid period we billed directly.
- The parts of these terms that by their nature should last, such as those on intellectual property, liability and governing law, stay in force after the agreement ends.
13. No warranties
We provide Petalface "as is" and "as available". We work to keep it running, safe and correct, but we do not promise that it will always be available, free of errors or secure, or that designs will meet your expectations. As far as the law allows, we give no other warranties, express or implied.
14. Limits of our liability
To the extent the law allows:
- We are not liable for indirect or consequential losses, lost profits or data, or losses caused by relying on AI results, including the cost of a salon visit, a hair colouring, a cut, a nail or beauty treatment, or any purchase based on a design.
- Our total liability to you is limited to the amount you paid us for Petalface in the 12 months before the claim.
- You will compensate us for claims by others caused by content you uploaded or by your breach of these terms.
Nothing in these terms limits liability that the law does not allow us to limit, such as for death or personal injury caused by negligence, or for fraud. Nothing in these terms takes away rights you have as a consumer under the law where you live.
15. Following the law
You may not use Petalface if you are in a country under a comprehensive embargo, or on a government list of people who may not receive services. You are responsible for following the laws that apply where you use Petalface.
16. Governing law and disputes
These terms are governed by the laws of Spain. Disputes go to the courts of Spain.
If you are a consumer, you keep the protection of the mandatory laws of the country where you live, and you can also bring a claim in its courts. We would like to hear from you first: most problems are solved with an email.
17. Changes to these terms
We may update these terms. The date at the top shows the latest version. If a change matters to you, we tell you in the app or by email before it applies. If you keep using Petalface after that, the new terms apply. If you do not accept them, stop using Petalface and cancel any subscription.
18. General
- If a court finds part of these terms invalid, the rest stays in force.
- You may not transfer your rights under these terms to anyone else. We may transfer ours to a company that takes over Petalface, without reducing your rights.
- If we do not enforce a right at once, we do not give it up.
- These terms and the privacy policy are the whole agreement between you and us about Petalface. If you got Petalface from the App Store or Google Play, section 19 and that store's own terms also apply, and section 19 wins where it differs from the rest.
19. If you got Petalface from the App Store or Google Play
App Store
If you downloaded Petalface from Apple's App Store, these terms also include the following, which win over anything else in them:
- These terms are between you and us, not Apple. We, not Apple, are responsible for Petalface and its content.
- Your right to use Petalface is limited to Apple-branded devices that you own or control, as the Usage Rules in Apple's Media Services Terms and Conditions allow, including use by other accounts through Family Sharing where those rules allow it.
- We alone provide maintenance and support for Petalface. Apple has no obligation to provide any maintenance or support for it.
- If Petalface fails to meet a warranty that applies to it, you may tell Apple, and Apple will refund the price you paid for Petalface, if any. To the extent the law allows, Apple has no other warranty obligation for Petalface. Any other claims, losses, liabilities, damages, costs or expenses caused by a failure to meet a warranty are our responsibility, as far as these terms and the law make them so.
- We, not Apple, are responsible for handling any claims by you or anyone else about Petalface or your use of it, including product liability claims, claims that Petalface fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- If anyone claims that Petalface or your use of it infringes their intellectual property rights, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
- You confirm that you are not in a country that is subject to a United States Government embargo or that the United States Government has designated as a "terrorist supporting" country, and that you are not on any United States Government list of prohibited or restricted parties.
- When you use Petalface, you must also follow the terms of third parties that apply to you, such as your mobile data provider's.
- Questions, complaints and claims about Petalface go to us, not Apple: Lucero Studio, Morlans, San Sebastián, Spain, support@petalface.com.
- Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple has the right, and is deemed to have accepted it, to enforce these terms against you as a third-party beneficiary.
Google Play
If you downloaded Petalface or bought Pro on Google Play, Google Play's Terms of Service also apply to the download and the purchase. Google is not a party to these terms and is not responsible for Petalface.
